Privacy concerns arise over new feature in Nintendo Switch 2

The highly anticipated Nintendo Switch 2 is set to launch this June, promising a wave of enhancements. One recent revelation involves the new “C Button,” which serves as a gateway to GameChat, a new communication feature. However, just as excitement builds, a recent update to Nintendo’s privacy policy has raised alarms regarding user data.

According to a report from GoNintendo this week, Nintendo has revised its privacy policy, with the updates focusing on data collection during GameChat usage. Specifically, Nintendo states:

“With your consent and to enforce our terms, we may monitor and record your video and audio interactions with other users.”

The policy further adds:

“When you use any of our services that include these or similar capabilities, we may collect your content under the terms of this policy and our user agreement.”

In a follow-up statement, Nintendo clarified that GameChat recordings are “privately stored on the device and not sent to Nintendo unless a report is submitted.”

While data collection of audio and video interactions isn’t unusual for online services with similar features, it’s a significant point future Switch 2 owners need to be aware of. Understanding what you're consenting to before pressing the C Button and launching GameChat is crucial.

Nintendo has also clarified the rollout of GameChat. All Switch 2 users will have free access to the feature at launch, but starting March 31, 2026, GameChat will require an active Nintendo Switch Online (NSO) subscription.

Importantly, even if users pay for NSO, it appears there is no option to opt out of Nintendo collecting audio and video data during GameChat usage. This raises questions about the balance between connected experiences and personal privacy on the new console. Users will need to weigh these concerns carefully before choosing to engage deeply with the communication feature.

The Nintendo Switch 2 has already seen tremendous early success. Several retailers have reported record-breaking pre-order numbers, making it difficult for many to secure a unit in the first wave.
